This Privacy Policy (“Policy”) describes how Credique Canada Inc. (“Credique,” “we,” “us,” or “our”) collects, uses, discloses, and protects your personal information when you visit https://www.identityprotect.ca or use any of our products and services (collectively, the “Services”). This Policy is an integral part of, and should be read together with, our Terms and Conditions.

Territorial Limitation. Our Services are offered to residents of Canada, excluding residents of the Province of Québec. By accessing or using the Site or Services, you represent and warrant that you are not a resident of Québec.

3. Personal Information & Applicable Privacy Laws

“Personal information” means information about an identifiable individual, as defined under Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (“PIPEDA”) and substantially similar provincial laws applicable outside Québec. This Policy covers only personal information as defined by applicable law and does not apply to information that is not personal information under those laws.

Depending on how you use the Services, we may collect the following categories of personal information:

  • Identity and contact details (e.g., name, mailing address, email address, phone number, date of birth, province of residence).
  • Billing and payment information (e.g., credit/debit card or other accepted methods).
  • Credit and financial information (e.g., credit report data, credit scores, alerts) obtained from our Providers (including TransUnion® Interactive, LLC) when you request Services requiring them; Social Insurance Number (optional) to assist with bureau matching.
  • Technical/usage data (e.g., IP address, device identifiers, browser type, operating system, access times, and page interaction).
  • Communications (e.g., support interactions, feedback, survey responses).

5. How We Use Personal Information

We use personal information to: provide and manage the Services; authenticate identity; conduct credit checks where a Service you request requires it; process payments and manage billing; send alerts and service communications; perform analytics and improve the Services; detect, prevent, and investigate fraud, abuse, or security issues; and comply with legal and regulatory obligations.

6. Cookies & Online Tracking

We use cookies and similar technologies (e.g., pixels, tags) for: (i) core functionality and security, (ii) remembering preferences, (iii) analytics and performance, and (iv) marketing/remarketing. We may use third‑party analytics and advertising partners that collect browsing information over time and across sites to help measure usage and deliver relevant ads. You can manage cookies in your browser; blocking some cookies may impair Site features. Where required, we will seek consent for non‑essential cookies.

7. Sharing and Disclosure of Information

We share personal information with service providers and Providers (e.g., credit bureaus such as TransUnion®), payment processors, cloud hosting, analytics vendors, and our affiliates to operate the Services. We may also share information to comply with law, enforce our terms, protect rights, or with your explicit consent. We do not sell personal information. We share with third parties for their own marketing only with your explicit consent.

8. Transfers Outside Canada

Personal information may be processed or stored outside Canada, including in the United States (e.g., by our Providers and cloud vendors). While abroad, it may be subject to foreign laws and accessed by courts, law enforcement, or national security authorities. We use contractual and organizational measures designed to protect personal information when transferred.

We implement reasonable administrative, technical, and physical safeguards (e.g., access controls, encryption in transit, network protections, and employee training) to protect personal information. No method of transmission or storage is completely secure; you are responsible for maintaining the security of your account credentials and device.

11. Credit Checks

Where a Service you request requires it, you authorize us and our Providers to conduct credit checks to verify your credit information and eligibility.

12. Retention

We retain personal information for as long as necessary to provide Services, meet legal and regulatory obligations, and resolve disputes. Records of payment authorizations are retained for a minimum of 12 months in accordance with Payments Canada Rule H1.

13. Changes to this Policy

We may update this Policy periodically. The “Last updated” date reflects the most recent revision. Continued use of the Services after changes take effect constitutes acceptance of the revised Policy.

14. Governing Law

This Policy and any disputes arising out of or related to it are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflicts of law principles.
